Your contract is with Howellsail Ltd. Registered in England, company number 5039877 whose registered office is at Beaufort House, 26 Manordale Close, Flockton. Wakefield. West Yorkshire WF4 4SX. Any reference to ‘the company’, ‘Howellsail’ or ‘We’, means Howellsail Ltd.

Payment and dispatch.

Payment for Online course fees is due in full at the time of enrolment. Payment for other courses, charters, yacht deliveries etc., by prior arrangement. All payments must be made in GB Pounds. Payment can be made by secure on line e-payment, cheque, or cash. We reserve the right to allow any payments to clear before dispatching your student pack and passwords. We aim to dispatch student packs within one working day of payment. Any goods are dispatched by post or courier, whichever is deemed the most appropriate.

Please let us know within 7 working days of the delivery date if anything in your course is damaged, faulty or missing. We will repair, replace or supply the items in question.

Howellsail Ltd is pleased to confirm that all customer data is handled confidentially and we do not disclose your information to any third party. By enrolling you confirm that we may hold necessary information about you including your name and address, course booking and course record details.

Cancellation.

You have the right to cancel your order for up to seven working days after your delivery date. If you do wish to cancel your course for any reason please send an email to info@howellsail.com. Any goods supplied by us must be returned within 10 working days of cancellation unopened and in new condition to Howellsail Ltd., at the customer’s expense. Damaged or goods not returned within 10 working days will result in a refund less the cost of the goods. An administration fee of £50 will be deducted from any refund. This is the full extent of our liability to you.

General.

Great care has been taken in preparing our course material; however we can accept no liability for any errors, omissions, or alterations, or for consequences ensuing upon the use of, reliance on, any information in a course. We reserve the right to make alterations and changes to the content without notice as part of our policy of continuous improvement. The On Line Package plus instruction and advice service provided by Howellsail Ltd is available to the student for a maximum of twelve months from the date of enrolment. The issue of completion certificates for RYA courses is conditional on the student having attained the standard of ability required by the RYA to the satisfaction of Howellsail Ltd.

The training charts, which are a compilation of numerous charts, and the practice tables are for training purposes only and must not be used for real navigation.

Copyright.

All material supplied, including material accessible on line and assessment and examination material is copyright, and the student undertakes to use the materials for personal use only. No other person shall be permitted to study, copy, or attempt to reproduce such material, or use it for any other purpose whatsoever without explicit written permission from Howellsail Ltd, our associates or suppliers.

Complaints and feedback.

If you do have any complaints about the Company, or the service provided, please address them in writing, by letter or email, as soon as possible to the Principal at Howellsail Ltd. We will acknowledge receipt by return or at the earliest possible time, advising you of when you should expect to receive a response. Any compliant will be recorded, investigate promptly, and you will be advised of the outcome and any proposals to resolve the issue. We do consider any complaints seriously and actively seek customer feedback as part of our constant endeavour to improve the service we offer.

Charter Bookings Terms and Conditions.

Telephone bookings will be held without deposit for a maximum of 24 hours.

Deposits are non refundable.

The balance is due one month before sailing.

In the event of non payment we reserve the right to re sell the charter and the deposit will be forfeited.

In the event of cancellation prior to the final balance being due only the deposit is forfeited.

If cancellation is after the date of final payment the client is liable to pay the outstanding balance, should we be unable to re let the space. At the company’s discretion we may transfer the reservation to an acceptable alternative date.

The company reserve the right to alter the published schedule or substitute an alternative vessel. If this is unacceptable to the client a full refund shall be made.

No responsibility what so ever will be accepted for air fares or other costs.

The company shall not accept claims and shall not be liable at any time for claims or expenses caused by circumstances beyond its control including sickness, accident, travel delays, weather, strikes, war or civil unrest.

In the event of the company cancelling a charter or course we shall be liable only for full refund of fees paid.

No payment will be paid for incidental costs.

No student or charterer shall bring aboard any contraband, drugs or other substance or item without the prior knowledge and permission of the skipper.

Signing the booking form signifies acceptance of the company’s terms and conditions.

In the event a dispute is not settled by mutual agreement it is agreed that The British Law Society shall appoint an arbiter whose decision shall be final and that wherever the dispute occurred both the client and the company shall be governed by British Law
